: O possuidor tem direito a ser mantido na posse em caso de turbação, restituído no de esbulho, e segurado de violência iminente, se tiver justo receio de ser molestado.&lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;/b&gt;&lt;br /&gt;&lt;b&gt;&lt;span class="Apple-style-span" style="font-size: large;"&gt;&lt;span class="Apple-style-span" style="color: #cc0000;"&gt;Turbação&lt;/span&gt; : significa qualquer ato ilícito (contrário à lei) que impede ou cria um obstáculo ao livre exercício da posse. Nesse caso, o rompimento de cercas, o trânsito de pessoas ou veículos de forma irregular na área que pertence ao proprietário ou possuidor.&lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;/b&gt;&lt;br /&gt;&lt;b&gt;&lt;span class="Apple-style-span" style="font-size: large;"&gt;&lt;span class="Apple-style-span" style="color: #cc0000;"&gt;Esbulho &lt;/span&gt;: é o ato pelo qual o possuidor se vê privado da posse, pode ser de forma violenta ou clandestina.&lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;/b&gt;&lt;br /&gt;&lt;b&gt;&lt;span class="Apple-style-span" style="font-size: large;"&gt;&lt;span class="Apple-style-span" style="color: #cc0000;"&gt;As ações possessórias &lt;/span&gt;: visam à proteção da posse, tanto de imóveis quanto de móveis. O Código de Processo Civil menciona as seguintes ações: o interdito proibitório, a manutenção e a reintegração na posse. &lt;br /&gt;&lt;br /&gt;&lt;span class="Apple-style-span" style="color: #cc0000;"&gt; Art. 1.219.&lt;/span&gt; do Código Civil Brasileiro  (indenização) O possuidor de boa-fé tem direito à indenização das benfeitorias necessárias e úteis, bem como, quanto às voluptuárias, se não lhe forem pagas, a levantá-las, quando o puder sem detrimento da coisa, e poderá exercer o direito de retenção pelo valor das benfeitorias necessárias e úteis.  &lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;/b&gt;&lt;br /&gt;&lt;b&gt;&lt;span class="Apple-style-span" style="font-size: large;"&gt;&lt;span class="Apple-style-span" style="color: #cc0000;"&gt;Art. 1.220&lt;/span&gt;. Ao possuidor de má-fé serão ressarcidas somente as benfeitorias necessárias; não lhe assiste o direito de retenção pela importância destas, nem o de levantar as voluptuárias.   &lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;/b&gt;&lt;br /&gt;&lt;b&gt;&lt;span class="Apple-style-span" style="font-size: large;"&gt;&lt;span class="Apple-style-span" style="color: #cc0000;"&gt;O usucapião&lt;/span&gt; : É uma forma de adquirir a propriedade sobre um bem imóvel.   Caso uma pessoa tenha a posse (ou seja, use-a como se dono fosse) de um bem imóvel, por determinado período de tempo, esta pessoa adquire a propriedade deste imóvel, cabendo apenas ao pode judiciário declarar (ou reconhecer) esta situação. Desta forma a  Ação de Reintegração de Posse ; pode ser movida que foi esbulhado (desapossado) da coisa que lhe pertence. Busca-se reavê-la e restaurar a posse perdida.e torna o legítimo proprietário daquele imóvel. &lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;/b&gt;&lt;br /&gt;&lt;b&gt;&lt;span class="Apple-style-span" style="font-size: large;"&gt;&lt;span class="Apple-style-span" style="color: #990000;"&gt;ATENÇÃO &lt;/span&gt;- Qualquer imóvel que não seja bem público pode ser adquirido através do usucapião. &lt;br /&gt;&lt;br /&gt;&lt;span class="Apple-style-span" style="color: #cc0000;"&gt; REGISTRO IMOBILIÁRIO&lt;/span&gt;&lt;br /&gt;Por determinação da Lei nº. 6.015/73, qualquer escritura para produzir os efeitos legais de transferência de domínio, disponibilidade e validade em relação a terceiros.&lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;/b&gt;&lt;br /&gt;&lt;b&gt;&lt;span class="Apple-style-span" style="font-size: large;"&gt;OBS: deverá ser apresentada para registro no Cartório de Registro de Imóveis competente.&lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;/b&gt;&lt;br /&gt;&lt;b&gt;&lt;span class="Apple-style-span" style="font-size: large;"&gt;&lt;span class="Apple-style-span" style="color: #cc0000;"&gt;Escritura Pública de Cessão de Direitos Possessórios:&lt;/span&gt;&lt;br /&gt;É a escritura em que uma pessoa detém a posse de um imóvel mas não é o proprietário jurídico/legal. A pessoa poderá ceder a posse que lhe pertence a outrem, que a manterá, até que se possa obter da justiça a propriedade plena do imóvel, através de uma ação de usucapião. A pessoa poderá ceder a posse que lhe pertence a outrem, que &lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;/b&gt;&lt;br /&gt;&lt;b&gt;&lt;span class="Apple-style-span" style="font-size: large;"&gt;&lt;span class="Apple-style-span" style="color: #cc0000;"&gt;REGISTROS PÚBLICOS LEI 6015 DE 31/12/1973&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;/b&gt;&lt;br /&gt;&lt;b&gt;&lt;span class="Apple-style-span" style="font-size: large;"&gt;&lt;span class="Apple-style-span" style="color: #cc0000;"&gt;Art. 8º &lt;/span&gt;– A Escritura Publica , é livre a escolha do Tabelião de notas, qualquer que seja o domicilio das partes ou o lugar de situação dos bens objeto do ato ou negócio.&lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;/b&gt;&lt;br /&gt;&lt;b&gt;&lt;span class="Apple-style-span" style="font-size: large;"&gt;&lt;span class="Apple-style-span" style="color: #cc0000;"&gt;Art. 1.196&lt;/span&gt; do Código Civil Brasileiro. “Considera-se possuidor , todo aquele que tem de fato o exercício, pleno ou não, de algum dos poderes inerentes à propriedade”.&lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;/b&gt;&lt;br /&gt;&lt;b&gt;&lt;span class="Apple-style-span" style="font-size: large;"&gt;&lt;span class="Apple-style-span" style="color: #cc0000;"&gt;ART. 1.200&lt;/span&gt; do  Cód. Civil Brasileiro - POSSE : É justa a posse que não for violenta clandestina ou precária&lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;/b&gt;&lt;br /&gt;&lt;b&gt;&lt;span class="Apple-style-span" style="font-size: large;"&gt;OBS:  A Lavratura da escritura Publica  declaratória da Posse , será necessariamente procedida de justificação de posse , realizada perante  o Tabelião de Notas (cartório) , mediante ato notarial que devera constar com a presença dos confrontantes  e de , no mínimo duas testemunhas que atestem inequivocamente a posse do requerente , devendo  constar  no texto  do ato os requisitos referidos no caput  do Art 414 e 415 e parágrafo único do Cód de processo Civil , no tocante a formalização da ouvida de testemunhas &lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;/b&gt;&lt;br /&gt;&lt;b&gt;&lt;span class="Apple-style-span" style="font-size: large;"&gt;Por que é importante registrar um título ou documento?&lt;br /&gt;&lt;span class="Apple-style-span" style="font-size: small; font-weight: normal;"&gt;&lt;b&gt;&lt;span class="Apple-style-span" style="font-size: large;"&gt;Para tornar incontestável o seu conteúdo, pois no Cartório de Títulos e Documentos qualquer pessoa pode conferir, a qualquer tempo, o que está registrado.&lt;/span&gt;&lt;/b&gt;&lt;/span&gt;&lt;/span&gt;&lt;/b&gt;&lt;br /&gt;&lt;b&gt;&lt;span class="Apple-style-span" style="font-size: large;"&gt; Para ter a garantia de uma cópia autêntica, verdadeira que, como certidão, passa a ter o mesmo valor do original, caso este seja extraviado, perdido ou danificado.&lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;/b&gt;&lt;br /&gt;&lt;b&gt;&lt;span class="Apple-style-span" style="font-size: large;"&gt;* Para dar autenticidade ao documento, pois com o registro ele não corre risco de ser fraudado. * Para deixar provado o texto original do documento, de modo que ninguém poderá alegar desconhecimento da sua existência. &lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;/b&gt;&lt;br /&gt;&lt;b&gt;&lt;span class="Apple-style-span" style="font-size: large;"&gt;* Sem o registro não adianta reconhecer firmas, pois o texto não fica assegurado e perpetuado.&lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;/b&gt;&lt;br /&gt;&lt;b&gt;&lt;span class="Apple-style-span" style="font-size: large;"&gt;&lt;span class="Apple-style-span" style="color: #cc0000;"&gt;Usucapião&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;Modalidade de aquisição de coisa imóvel ou móvel em razão do decurso do tempo desde que atendidos determinados requisitos definidos na lei civil. Por exemplo, o usucapião de imóvel: aquele que, por vinte anos, sem interrupção, nem oposição, possuir como seu um imóvel, adquirir-lhe-á o domínio, independentemente de título de boa fé que, em tal caso, se presume, podendo requerer ao juiz que assim o declare por sentença, a qual lhe servirá de título para transcrição no Registro de Imóveis. Aquele que possuir como sua área ou edificação urbana de até duzentos e cinqüenta metros quadrados, por cinco anos, ininterruptamente e sem oposição, utilizando-a para sua moradia ou de sua família, adquirir-lhe-á o domínio, desde que não seja proprietário de outro imóvel urbano ou rural. O título de domínio será conferido ao homem ou à mulher, ou a ambos, independentemente do estado civil. Este direito não será reconhecido ao mesmo possuidor mais de uma vez. Aquele que, por vinte anos, sem interrupção, nem oposição, possuir como seu um imóvel, adquire o domínio, independentemente de título de boa fé que, em tal caso, se presume, podendo requerer ao juiz que assim o declare por sentença, a qual lhe servirá de título para transcrição no Registro de Imóveis. Veja Art. 550 do Código Civil.&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;&lt;span class="Apple-style-span" style="color: #cc0000; font-weight: bold;"&gt; Usucapião ordinário&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;b&gt; É uma das modalidades de aquisição da propriedade imóvel. Trata-se da obtenção do domínio do imóvel aquele que, por dez anos entre presentes, ou quinze entre ausentes, o possuir como seu, contínua e incontestadamente, com justo título e boa-fé. Veja Art. 551 do Código Civil.&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;&lt;span class="Apple-style-span" style="color: #cc0000; font-weight: bold;"&gt; Usucapião rural ou especial&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;b&gt; É uma das modalidades de aquisição da propriedade imóvel. Aquele que, não sendo proprietário de imóvel rural ou urbano, possua como seu, por cinco anos ininterruptos, sem oposição, área de terra, em zona rural, não superior a cinqüenta hectares, tornando-a produtiva por seu trabalho ou de sua família, tendo nela sua moradia, adquirir-lhe-á a propriedade. &lt;/b&gt;&lt;br /&gt;&lt;span class="Apple-style-span" style="font-family: Arial, Helvetica, sans-serif;"&gt;&lt;span class="Apple-style-span" style="line-height: 15px;"&gt;&lt;br /&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;br /&gt;&lt;span class="Apple-style-span" style="font-weight: bold; line-height: 15px;"&gt;&lt;span class="Apple-style-span" style="color: #cc0000; font-family: Arial, Helvetica, sans-serif;"&gt;"&lt;/span&gt;&lt;span class="Apple-style-span" style="color: white;"&gt;&lt;span class="Apple-style-span" style="font-family: Arial, Helvetica, sans-serif;"&gt;CC. art. 1255&lt;/span&gt;&lt;span class="Apple-style-span" style="font-family: Arial, Helvetica, sans-serif;"&gt;. Aquele que semeia, planta ou edifica em terreno alheio perde, em proveito do proprietário, as sementes, plantas e construções; se procedeu de boa-fé, terá direito à indenização.&lt;br style="margin-bottom: 0px; margin-left: 0px; margin-right: 0px; margin-top: 0px; padding-bottom: 0px; padding-left: 0px; padding-right: 0px; padding-top: 0px;" /&gt;Parágrafo único. Se a construção ou a plantação exceder consideravelmente o valor do terreno, aquele que, de boa-fé, plantou ou edificou, adquirirá a propriedade do solo, mediante pagamento de indenização fixada judicialmente, se não houver acordo&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span class="Apple-style-span" style="color: white;
